What is the law now?

Cannabis is currently a class B drug. You can be arrested for possession wherever you are. The maximum sentence for possession is five years, and dealers can face life. But most users escape with a fine and most dealers with short jail sentences.

When the law changes will cannabis still be illegal?

Yes. It will still be a criminal offence to possess cannabis in any form and in any quantity.

Can I be arrested?

Yes, police will still be able to arrest people who possess cannabis. But they have been issued with guidelines that mean that most people who are stopped by police will have the drug confiscated and be given a warning. Officers should only arrest repeat offenders or those smoking in a public place, threatening public order or found near premises used by children, such as schools. In other words, you will not be arrested for smoking at home.

So I can't have a joint in the street?

No. You could still be arrested - especially if you are near a school.

What punishment could I receive?

Most people will escape with a warning - but it is still possible to be jailed for possession of cannabis with a maximum term of two years.

I'm under 18. Are things any different?

Yes. Police have been told to arrest under-18s they find in possession of cannabis. The first time they will issue a formal reprimand. If you commit a second offence you will either be charged, which will mean you go on trial, or be given a final warning, which will mean being automatically referred to a rehabilitation programme.

Will there be cannabis café³€

No. If somebody tries to set one up they will be treated as a dealer - meaning they face a maximum sentence of 14 years in prison.

I smoke cannabis because I suffer from multiple sclerosis. Will I be arrested?

It is unlikely as long as you do it in the privacy of your own home. But cannabis is not legal for medical use - and the law is not going to be changed to make it legal.
